As a member of the Paris Convention, PCT, EPC, TRIPS and the European Union, Sweden offers many possibilities within the field of intellectual property, both when it comes to obtaining patent protection within its territory and when it comes to providing a platform for obtaining patent protection in other countries. A European patent can be obtained by filing a European patent application directly, possibly claiming priority from an earlier application, or through a PCT application designating EP. The time limit for entering the regional phase under Chapter I or Chapter II is 31 months from the priority date. Currently, patent protection can be obtained in 31 European countries through a single European patent application.

 

For obtaining patent protection in Sweden three major routes are provided.

The first way is to file a national patent application directly with the Swedish Patent Office, possibly claiming priority from an earlier application from virtually any country.

The second way is through a PCT application designating Sweden. The time limit for entering the national phase under Chapter I is 20 months from the priority date. The time limit for entering under Chapter II is 30 months. However, patent protection in Sweden through a PCT application can still be obtained through a Euro-PCT application as the time limit for entering the regional phase is 31 months from the priority date.

The third way is through a European patent application designating Sweden. To validate a European patent in Sweden a Swedish translation of the specification must be filed with the Swedish Patent Office within three months from grant.
