TRADEMARKS
As a member of the European Union and the Madrid Protocol, Sweden offers four possibilities to obtain trademark protection in the country. No matter which form of protection you choose; Hansson Thyresson Patentbyrå AB offers professional representation before OHIM, WIPO, the Swedish Patent and Registration Office and the Swedish Courts.
National Registration and Establishment Swedish national trademark applications are examined by the Swedish Patent and Registration Office. Provided there are no obstacles, for example in the form of confusingly similar trademarks, the trademark will be registered. If no opposition is filed against the trademark within two months from the registration date, the registration has acquired legal force and is valid ten years from the registration date.
A trademark can also be protected in Sweden through establishment. It is however safest to apply for registration, as you can then prove your exclusive right with the Certificate of Registration.
Community Trademark Registration It is also possible to obtain trademark protection in Sweden by filing a Community Trademark Application in the OHIM office in Alicante. Through one single application the trademark can be protected in all countries of the European Union.
International Registration (Madrid Protocol) The Madrid Protocol is an agreement among a large number of countries on International Registration of trademarks. Sweden has joined of the Madrid Protocol and it is possible to obtain protection by designating Sweden in your application for an International Registration.
Should you receive a Provisional Refusal issued by the Swedish Patent and Registration Office, the proceedings will enter into a national phase, and a response will have to be filed with the Swedish Patent and Registration Office through the intermediary of a local agent.
